Botsford Trial Against Enbridge's Use of Eminent Domain

In early August we will attend the jury trial of the Botsford family in Grand Forks, ND.   The trial is 4-days, August 11-14, 2015, and we will be supporting James and Krista Botsford as they defend themselves against Enbridge, who wants to condemn their farm to make room for their Sandpiper pipeline.  The case will be be high-profile and will set some precedent about whose rights are honored more, pipelines or human beings.   It will be the first ever trial of it's kind in the region.  

James Botsford is an attorney who has worked extensively for Native people for decades, and serves as a judge for the Winnebago Tribe of Nebraska. He has retired from his law practice, but is highly regarded nationally for his work for Rueben Snake on Religious Freedom.  James and Krista Botsford have a farm which they inherited from their ancestors, and they wish to keep the land.  They will not allow Enbridge to build a pipeline full of dangerous, volatile Bakken oil on their land.  Enbridge, operating as "the North Dakota Pipeline Company" has been declared a public utility in North Dakota, and as such has been given rights to eminent domain.  However, James and Krista and their attorneys do not believe that Enbridge should be declared a public utility, and do not wish to have the company on the family land.  
"This is land that has been in my family for decades. It is prime Red River valley agriculture land. It was handed down to me by my mother and father when they passed away, and I’m intending to hand it down to my children when I pass away ….  My wife and I have …told our children that we   will pass this on.  Of course if 225,000 barrels of oil bursts through this thing, that certainly is the end of this family legacy," said James.
